The Contract Labour Act, 1970 regulates employment of contract labour in establishments with 20 or more contract workers. Both the principal employer (the establishment) and the contractor (who supplies workers) have separate registration and licensing obligations under the Act.
Both. The principal employer must register their establishment with the Registering Officer. The contractor must obtain a separate licence specifying the maximum number of workers that can be deployed, the nature of work, and the period of validity. Operating without either registration or licence attracts penalties.
The central Act applies when 20 or more contract workers are employed. Some states have reduced this to 10 workers. Below these thresholds, registration is not mandatory under the central Act, but state-specific rules may still apply.
Violation can result in imprisonment of up to 3 months and/or a fine of up to ₹1,000. The licence can also be cancelled or suspended. For ongoing violations, additional daily fines may be imposed by courts.
Generally valid for 12 months and must be renewed annually before expiry. Renewal applications should be filed at least 30 days before the expiry date. Late renewal attracts a fee, and operating on an expired licence is treated as operating without a licence.
