A Pollution NOC refers to the Consent to Establish (CTE) and Consent to Operate (CTO) issued by State Pollution Control Boards (SPCBs) under the Water (Prevention & Control of Pollution) Act 1974, Air (Prevention & Control of Pollution) Act 1981, and the Environment (Protection) Act 1986. CTE is required before setting up an industrial or commercial unit; CTO is required before commencing operations. Both must be renewed periodically.
Industries are categorised by pollution potential — Red (highly polluting), Orange (moderately polluting), Green (low polluting), and White (non-polluting). The category determines the fee, inspection frequency, and effluent/emission standards the unit must comply with. Operating without a valid CTE/CTO is a criminal offence under Section 43 of the Water Act, attracting imprisonment of up to 6 years and/or fine.
Environmental Clearance (EC) is a separate authorisation issued by the Ministry of Environment, Forest and Climate Change (MoEFCC) or State Environment Impact Assessment Authorities (SEIAAs) under the EIA Notification 2006 — required for large-scale projects above specified thresholds. Many large projects require both EC and CTO.
Any industrial or commercial unit that discharges effluents, emits air pollutants, or generates hazardous waste requires Pollution Board consent before establishing or operating.
All manufacturing industries — small, medium, and large — require CTE before establishing and CTO before commencing production operations.
Dairy plants, slaughterhouses, cold storages, and food processing units fall under Orange or Red categories and require SPCB consent before operations.
Red category industries with high effluent and emission potential require detailed environmental management plans and ETP/STP installation before consent is granted.
Large construction projects above prescribed thresholds require Environmental Clearance from SEIAA or MoEFCC before commencement of construction activity.
Effluent Treatment Plants (ETP), Sewage Treatment Plants (STP), and Common Effluent Treatment Plants (CETP) require separate authorisation under hazardous waste rules.
Mining and quarrying projects require Environmental Clearance from the Ministry of Environment under the EIA Notification 2006, in addition to SPCB consent.
