What is a Pollution NOC in India?

A Pollution NOC refers to the Consent to Establish (CTE) and Consent to Operate (CTO) issued by State Pollution Control Boards (SPCBs) under the Water (Prevention & Control of Pollution) Act 1974, Air (Prevention & Control of Pollution) Act 1981, and the Environment (Protection) Act 1986. CTE is required before setting up an industrial or commercial unit; CTO is required before commencing operations. Both must be renewed periodically.

Industries are categorised by pollution potential — Red (highly polluting), Orange (moderately polluting), Green (low polluting), and White (non-polluting). The category determines the fee, inspection frequency, and effluent/emission standards the unit must comply with. Operating without a valid CTE/CTO is a criminal offence under Section 43 of the Water Act, attracting imprisonment of up to 6 years and/or fine.

Environmental Clearance (EC) is a separate authorisation issued by the Ministry of Environment, Forest and Climate Change (MoEFCC) or State Environment Impact Assessment Authorities (SEIAAs) under the EIA Notification 2006 — required for large-scale projects above specified thresholds. Many large projects require both EC and CTO.

What is the difference between CTE and CTO?
Consent to Establish (CTE) is required before setting up an industrial unit — it approves the proposed project plan, layout, and environmental safeguards. Consent to Operate (CTO) is required before commencing production operations — it confirms that the installed plant, ETP, and emission controls are functioning as approved. Both are issued by the State Pollution Control Board. Once CTO is obtained, it must be renewed periodically (typically every 1–5 years depending on category and state rules).
Which industries are in the Red category under CPCB norms?
The Central Pollution Control Board (CPCB) classifies 17 categories as "Severely Polluting Industries" (Red list) based on a Pollution Index. Red category includes cement, paper and pulp, thermal power plants, sugar mills, distilleries, pharmaceutical formulations, tanneries, caustic soda, and chlor-alkali plants. Red category units require more stringent documentation, an ETP mandatory before CTO is granted, and are subject to more frequent SPCB inspections. How often must a Pollution NOC be renewed?
CTO renewal frequency depends on the industry category and the state's rules. Typically, Red category units renew every year, Orange category every 2–3 years, and Green/White category every 5 years. However, state-specific rules may differ — some states issue a single long-term CTO valid for the life of the project for compliant units. Does a small workshop or micro-enterprise need a Pollution NOC?
Micro and small enterprises in the White category (non-polluting) do not need a Pollution NOC as per CPCB guidelines — they are only required to submit a self-declaration. However, if the activity involves any emissions, effluents, or hazardous waste generation, consent is required regardless of scale.
