Important TDS Information

TDS Due Date for Deposit

TDS must be deposited with banks within7 days from the end of the monthin which the payment was made. For example, if payment is made in June, TDS must be deposited by 7 July. There is a special due date of 30 April for TDS deducted in March.

PAN Requirement (Section 206AA)

If the payee has not furnished their PAN, the TDS rate isdoubled(or 20% if no specific rate is mentioned). This is a penalty for non-compliance. Always collect PAN before making payments.

TDS Credit in Income Tax Return

The deductee can claim the TDS paid as a credit against their income tax liability while filing the annual return. Form 16A is issued by the deductor, and Form 26AS on the Income Tax portal shows all TDS credits.

What is the due date for TDS deposit?+
TDS must be deposited within 7 days from the end of the month in which the payment was made. For example, if you deduct TDS in June, it must be deposited by 7 July. For March TDS, the special due date is 30 April (before the financial year ends).
What is the difference between Form 16 and Form 16A?+
Form 16 is issued by employers to employees for TDS deducted on salary during the financial year. Form 16A is issued for TDS deducted on payments other than salary (like contractor payments, professional fees, commissions, etc.). Both are used to claim TDS credit in income tax returns.
How can I claim TDS credit in my income tax return?+
You can claim TDS credit in your ITR (Income Tax Return) under Schedule TDS. You need the TDS certificates (Form 16 or 16A) issued by the deductor. You can also verify TDS deducted on your PAN through Form 26AS on the Income Tax e-portal. The TDS paid is credited against your total tax liability.
What happens if TDS is deducted without PAN?+
If PAN is not furnished, the TDS rate is doubled as per Section 206AA. For example, instead of 10% (194A interest), it becomes 20%. The payee will not get credit for this excess TDS easily. Always provide PAN to your deductors to avoid this penalty deduction.
Is there a threshold below which TDS is not deducted?+
Yes. Most TDS sections have a threshold limit. For example, Section 194A (interest) has a threshold of ₹40,000 (₹50,000 for senior citizens). Section 194C (contractor) has ₹30,000 per transaction or ₹1 lakh aggregate. Check the applicable threshold for your payment type before deducting TDS.
Can I get a refund if excess TDS is deducted?+
Yes, if TDS is deducted in excess of your tax liability, you can claim a refund while filing your income tax return. The refund is processed after verification by the tax department. This is why filing ITR on time is important even if no tax is payable.
What is the penalty for not depositing TDS on time?+
If TDS is not deposited by the due date, interest @1% per month is charged under Section 234E on the delayed TDS. Additionally, penalties under Section 271E may be imposed. The interest keeps accruing until the TDS is deposited, so timely deposit is crucial.
