Every industry setting up a new factory or expanding must obtain Consent to Establish (CTE) from the State Pollution Control Board before construction begins.
Pollution NOC, officially called Consent to Establish (CTE), is issued by the State Pollution Control Board (SPCB) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. It is the first clearance required before setting up any industry that might discharge pollutants into water, air or land. No construction or installation of plant and machinery can begin without CTE.
Apply on the State PCB online portal (OCEMS or state equivalent).
Upload all technical documents, site plans and EIA report if required.
PCB examines the application for completeness and schedules inspection.
PCB Inspector visits proposed site to verify land use and environment sensitivity.
High-risk industries reviewed by PCB Technical Committee for conditions.
Consent to Establish issued with specific conditions for implementation.
⏱Expected timeline:15–30 working days (Standard); 10–15 working days (Premium — PCB follow-up)
⚠️Warning:Commencing construction without CTE attracts closure orders, fines up to ₹1,00,000 plus ₹5,000/day under Water Act, imprisonment up to 6 years, and criminal prosecution of all directors.
